Information about Revocation
Right of Revocation
You have the right to revoke this agreement within 30 days without providing any reason.
The revocation period is 30 days from the date:
● On which you, or a third party designated by you (other than the carrier), takes possession of the goods, provided that you have ordered one or more goods in one order and they are delivered together;
● On which you, or a third party designated by you (other than the carrier), takes possession of the last good, provided that you have ordered multiple goods in one order and they are delivered separately.
To exercise your right of revocation, you must inform us of your decision to revoke this agreement. You can do this by email: support@modiqwear.com.
You may use the attached model cancellation form, but it is not mandatory.
To comply with the revocation period, it is sufficient for you to send us the notification of your decision to exercise the right of revocation before the revocation period expires.
Consequences of Revocation
If you revoke this agreement, we will refund all payments we have received from you, including the costs of delivery (except for additional costs resulting from your choice of a delivery method other than the standard delivery offered by us), without undue delay and no later than 30 days from the date we received your revocation notice.
We will use the same payment method for this refund as you used for the original transaction, unless expressly agreed otherwise. In any case, this refund will not incur any costs for you.
We may withhold the refund until we have received the returned goods, or you have provided proof that you have returned the goods, whichever comes first.
You must return the goods immediately and no later than 30 days from the date you informed us of your decision to revoke the contract. The deadline is met if you send back the goods before the 30-day period expires.
The direct costs of returning the goods are for your account.
You are only liable for the diminished value of the goods if the loss in value is due to handling the goods beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
Reasons for Exclusion and Expiration of the Right of Revocation
The right of revocation does not apply to agreements:
● For the delivery of goods that are not prefabricated and which are manufactured according to the consumer's individual choice or decision;
● For the delivery of goods that can spoil quickly or have a limited shelf life;
● For the delivery of alcoholic beverages where the price is agreed upon in the contract, but which can only be delivered no earlier than 30 days after the conclusion of the contract, and whose value depends on market fluctuations;
● For the delivery of newspapers, magazines, or periodicals, with the exception of subscriptions.
The right of revocation expires prematurely in the case of agreements:
● For the delivery of sealed goods that are not suitable for return for health or hygiene reasons, if the seal has been broken after delivery;
● For the delivery of goods that, by their nature, are inseparably mixed with other goods after delivery;
● For the delivery of audio and video recordings and computer software in sealed packaging, if the seal has been broken after delivery.
